Federal gun charges are extremely common in the Eastern District of Michigan. Federal firearm charges can exist in numerous ways, both as independent cases, and as enhancements to other charges, such as RICO. Federal gun charges sometimes carry mandatory minimum prison time. Federal gun charges are very serious and handling these types of federal gun criminal cases must be left to the experienced federal criminal gun lawyers, like us.

The Use of Federal Firearm Charges in Conspiracy Cases

One of the most prolific ways the United States Attorney for the Eastern District of Michigan uses federal firearm charges is to include them when firearms are discovered or used during an alleged conspiracy. If the firearm was used in any way, then an 18 USC §924(c) charge is generally sought. A 924(c) charge added to a conspiracy case can result in additional mandatory consecutive time, such as an additional five years in federal prison simply for possessing a firearm during the commission of a federal offense.

Individual Federal Firearm Charges

Beyond the usual 924(c) charges, there are specific federal criminal firearm crimes that are routinely charged in the Michigan federal courts. For example, it is illegal to possess a machine gun or short barrel rifle. These cases carry the potential for major federal prison time. A majority of federal gun crime is investigated by the ATF, who we routinely deal with.

Federal Gun Charge Defense

There are many ways to fight a federal gun charge in the Eastern District of Michigan. For example, in a RICO case, it could be argued that a gun discovered had nothing to do with the conspiracy. In a machine gun case, we could have the firearm tested for DNA. We’ve even successfully argued that what the Government thought was a gun was actually a BB gun!
