Residential Drug Abuse (RDAP) Programs Shorten Federal Sentences

Most federal clients of ours want to know every available method of eliminating time in federal prison. One of the most common ways is for the client to be accepted to a residential drug treatment program. An RDAP program is an intense 500 hour rug rehabilitation program. What this does is reduce the inmates federal sentence.

How Does an RDAP Program Reduce a Sentence?

A federal inmate who completes the RDAP program can have their sentence reduced by up to twelve months. This is in addition to being released early into a halfway house for drug treatment.

Eligibility for the Federal RDAP Program

There are certain types of convictions and other activities that make one become ineligible for the RDAP program, such as having a firearm component to the underlying crime. Also, it is wise to request to the Federal Sentencing Judge placement in the RDAP Program during sentencing. Finally, it is a voluntary program that requires intensive participation.

A major mistake made by lawyers who are not experienced in federal criminal law is to represent to the federal court during sentencing that their client does not have a substance abuse problem.
